1. Agreement to Terms

By accessing or using A11y Form Validator ("the Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

These Terms apply to all users of the Service, including without limitation users who are browsers, vendors, customers, merchants, and contributors of content.

2. Description of Service

A11y Form Validator is a Webflow Designer Extension that provides form validation services with WCAG 2.2 AA conformance. The Service includes:

  • Form validation functionality for Webflow forms
  • Accessibility compliance features
  • Custom validation message configuration
  • File upload validation rules
  • Styling customization options
  • Analytics and usage tracking
  • Subscription-based access to various plan tiers

3. Account Registration and Security

3.1 Account Creation

  • You must create an account to use the Service
  • You may register through Webflow OAuth or other authentication methods we provide
  • You must provide accurate, current, and complete information during registration
  • You are responsible for maintaining the confidentiality of your account credentials

3.2 Account Security

  • You are responsible for all activities that occur under your account
  • You must immediately notify us of any unauthorized use of your account
  • We are not liable for any loss or damage arising from your failure to protect your account credentials
  • You may not share your account with others or allow others to access your account

3.3 Account Eligibility

  • You must be at least 18 years old to use the Service
  • You must have the legal capacity to enter into binding agreements
  • You represent that all information you provide is truthful and accurate

4. Subscription Plans and Billing

4.1 Available Plans

The Service offers various subscription plans with different features and limitations: Starter Plan (Free), Core Plan, Pro Plan, Growth Plan, Single Site Plan, and Unlimited Plan. Plan features, limitations, and pricing are subject to change. Current plan details are available on our billing page.

4.2 Subscription Terms

  • Subscriptions are billed on a monthly or annual basis, as selected during purchase
  • Subscriptions automatically renew unless cancelled before the renewal date
  • You authorize us to charge your payment method for all subscription fees
  • Subscription fees are charged in advance for the billing period

4.3 Payment Processing

Payments are processed securely through Stripe. You agree to provide valid payment information and authorize us to charge your payment method for all fees associated with your subscription. All fees are non-refundable except as required by law or as stated in our refund policy.

4.4 Price Changes

We reserve the right to modify subscription prices at any time. Price changes will not affect your current subscription period. You will be notified of price changes before your next billing cycle. Continued use of the Service after a price change constitutes acceptance of the new pricing.

4.5 Failed Payments

If payment fails, we may suspend or terminate your subscription. You remain responsible for all charges incurred. We may charge a late fee or interest on overdue amounts. We reserve the right to use collection agencies or legal action to recover unpaid amounts.

5. Refund Policy

5.1 Refund Eligibility

  • Refunds are provided only as required by law or at our sole discretion
  • Refund requests must be submitted within 30 days of the original purchase
  • Refunds are not available for partially used subscription periods
  • Refunds may be prorated based on the unused portion of your subscription

5.2 Refund Process

  • Refund requests must be submitted through our support channels
  • We will process eligible refunds within 10 business days
  • Refunds will be issued to the original payment method
  • Processing fees may apply and are non-refundable

6. Service Availability and Modifications

6.1 Service Availability

We strive to maintain Service availability but do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, updates, or technical issues. We are not liable for any loss or damage resulting from Service unavailability.

6.2 Service Modifications

We reserve the right to modify, suspend, or discontinue the Service at any time. We may add, remove, or modify features without prior notice. We are not obligated to provide updates or new features. Changes to the Service will not entitle you to refunds or credits.

7. Acceptable Use

7.1 Permitted Use

You may use the Service only for lawful purposes and in accordance with these Terms. You agree to:

  • Use the Service in compliance with all applicable laws and regulations
  • Respect the intellectual property rights of others

8. Intellectual Property Rights

You retain ownership of any content you create or upload using the Service. You grant us a license to use, store, and process your content as necessary to provide the Service. You represent that you have the right to grant such license. We may use aggregated, anonymized data for analytics and service improvement.

8.3 Feedback

Any feedback, suggestions, or ideas you provide may be used by us without compensation. You grant us a perpetual, irrevocable license to use such feedback.

9. Third-Party Services and Integrations

9.1 Third-Party Services

The Service integrates with third-party services, including Webflow (OAuth authentication and API access), Stripe (payment processing), Supabase (database and authentication services), and Netlify (application hosting).

9.2 Third-Party Terms

Your use of third-party services is subject to their respective terms and conditions. We are not responsible for the availability, accuracy, or practices of third-party services. You acknowledge that third-party services may have their own privacy policies and terms.

10. Limitation of Liability

10.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10.3 Exceptions

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless A11y Form Validator, Graceful Web Studio, and their officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Service, your violation of these Terms, your violation of any rights of another party, or your violation of any applicable laws or regulations.

12. Termination

12.1 Termination by You

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will continue to have access to the Service until the end of your billing period. No refunds will be provided for the remaining subscription period.

12.2 Termination by Us

We may terminate or suspend your account and access to the Service immediately, without prior notice, for violation of these Terms, fraudulent, abusive, or illegal activity, non-payment of fees, or any other reason we deem necessary.

12.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. We may delete your account and associated data. You remain liable for all charges incurred prior to termination. Provisions that by their nature should survive termination will remain in effect.

13. Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.

13.2 Dispute Resolution Process

Any disputes arising from these Terms or the Service shall be resolved through good faith negotiation. We will update the "Last Updated" date when Terms are modified. Significant changes will be communicated via email or Service notification. If you do not agree to the modified Terms, you must stop using the Service.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

15.3 Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of such provision.

15.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

15.5 Force Majeure

We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, or internet failures.
